How to Use "Re-File" to Resubmit Rejected Filings

Our new Re-File Rejected Filings feature streamlines the process of resubmitting rejected court filings for eFiling courts. This guide will walk you through the key functionality and workflows for both full and partial rejections, helping you save time and effort.

Previously, rejected filings required manual re-entry of all information and documents, leading to delays and redundant effort. With this feature:

  • Save time: Reuse previously entered information without starting over.
  • Avoid errors: Pre-populated fields reduce the risk of mistakes.
  • Maintain consistency: Easily correct and resubmit filings.

Use cases

The feature supports the following scenarios:

  1. Case Initiation (Full and Partial Rejections)
  2. Subsequent Filings (Full and Partial Rejections)
  3. Bundled File + Serve and/or File + Serve + File

Note: This feature is currently available for eFiling courts only. For physical filing rejections, our team contacts the filer directly to address any issues and return the corrected documents to the court.

Step-by-step guide

Case initiation – Full rejection

When an entire case initiation order is rejected:

  1. Navigate to the Order Details page of the rejected filing and click the Re-File button.
  2. You’ll be redirected to the case initiation eFiling workflow, where all information from the rejected order (e.g., party names, documents) is pre-populated.
  3. Carefully review and correct any errors. For example:
    • Party names: Fix any misspellings.
    • Documents: Replace or edit any files flagged as problematic.
  4. Continue through the workflow and make necessary adjustments.
  5. Submit the revised order.

Case initiation – Partial rejection

For partially rejected filings where a case number is generated:

  1. Navigate to the Order Details page and click the Re-File button.
  2. You’ll enter the Subsequent Filing Workflow, as the court has already created a case.
  3. Previously accepted documents will remain associated with the case. Only rejected documents need to be corrected and re-uploaded.
  4. Review party details, document attachments, and fees.
  5. Submit the corrected filing.

Reminder: Do not re-upload accepted documents, as they are already part of the case record and will be rejected if resubmitted.

Subsequent filing – Full rejection

When a subsequent filing is fully rejected:

  1. Navigate to the Order Details page and click Re-File.
  2. All previously entered information will be pre-populated, including:
    • Selected parties.
    • Document types.
    • Hearing dates and fees (if applicable).
  3. Make corrections where necessary, such as:
    • Deleting and re-uploading problematic documents.
    • Adjusting fees or party details.
  4. Submit the revised filing.

Subsequent filing – Partial rejection

For partial rejections of subsequent filings:

  1. Navigate to the Order Details page and click Re-File on the rejected order.
  2. Previously accepted documents remain available for reference and process serving (if the original order included a Service of Process bundle, e.g. File + Serve + File or File + Serve).
  3. Update and re-upload only the rejected documents.
  4. Verify and adjust any associated party details, fees, or options.
  5. Submit the corrected filing.

Key Features and Notes

  • Prevent Duplicate Re-submissions: Once your rejected filing is successfully resubmitted, the Re-File button on the Order Details page will become disabled, and the date and time of the resubmission will appear below the greyed-out Re-File button.
  • Pre-Population of Data: The system automatically fills in details from the rejected order, reducing manual input.
  • Editable Fields: Any errors flagged during rejection can be corrected directly within the workflow.
  • Process Serving Bundles: Process serving orders associated with rejected filings are updated and resubmitted automatically. If you need to review or amend documents before the job is dispatched to a process server, be sure to check the box for “Review process serve” in the eFiling workflow.

Important: Always review your filing carefully before resubmitting to avoid repeated rejections.
