How to apply a fee waiver or apply for a fee waiver when eFiling

If you are filing on behalf of a party who is exempt from standard filing fees or who has a fee waiver already on file with the court, you must be sure to indicate this when placing your eFiling order. One Legal also waives eFiling charges for filers with a court-approved fee waiver.

How to notify the court of fee exemptions

To do this, begin an eFiling order into the court of your choice. On the Add Filed By Party screen, check the box next to Party is exempt from fees.

Once checked, select the exemption reason Government Agency or Fee Waiver. If you select Fee Waiver, you must attach the Fee Waiver application here if it is not already on file with the court. Do not attach it with the rest of your filing documents.

Please note that the application is subject to the court’s approval. If not approved, the filer is responsible for all applicable fees.

If you do not already have a fee waiver on file…

Your filing must include both a fee waiver application and order (Forms FW-001 & FW-003), and these must both be submitted together. These can be added on the Documents screen along with the other documents being filed.
